Adam Montgomery is appealing his weapons-related conviction and sentencing as he prepares for his impending murder trial this November. In June, Montgomery was found guilty of eight charges related to firearm thefts, resulting in a 30-year prison sentence, with up to 60 years on armed career criminal charges. He also received an additional 7 1/2 to 15 years for receiving stolen property and theft. This week, his legal team filed a notice of appeal and an application for sentence review. Their appeal raises specific questions, including:

1. Whether the Court erred in denying the Defendant’s Motion to Preclude Testimony of Kayla Montgomery?
2. Whether the Court erred in allowing Kimberly Frain to testify about rumors regarding the defendant's alleged gun thefts?
3. Whether the Court erred in refusing to strike portions of the ATM video referencing character evidence?
4. Whether the Court erred in permitting testimony concerning the defendant’s phone number appearing on John Sargent's contact list?

In addition to his weapons charges, Montgomery is scheduled to face trial in November for the murder of his missing daughter, 5-year-old Harmony Montgomery. Authorities allege that he killed Harmony in December 2019, although her disappearance was not reported until November 2021. He was charged with her murder in October 2022, and investigators are still actively searching for her remains. According to a probable cause affidavit, Montgomery's estranged wife, Kayla Montgomery, claimed that he fatally struck Harmony in December 2019, and they spent several months moving the child's remains before ultimately disposing of them in the spring of 2020.
