The community benefit standard has been the basis of tax-exemption for hospitals since the 1960s. However, the Patient Protection and Affordable Care Act of 2010 established additional requirements that each §501(c)(3) tax exempt hospital facility must meet to maintain exempt status, including a Community Health Needs Assessment conducted at least every three years; a written financial assistance policy and emergency medical care policy; limitations on amounts charged to FAP-eligible individuals; and a prohibition against taking extraordinary collection actions prior to reasonable efforts to determine if a patient is FAP-eligible. This podcast, featuring Plante Moran healthcare tax compliance specialists Sue Miencier and Jamie Miller, gives a high-level overview of these requirements so that listeners can ensure they are compliant going forward.
