Leslie is joined by Megan Salrin and Jimmy O'Donnell of the United Steelworkers (USW). The trio analyzes why workers need a Pro-Labor National Labor Relations Board (NLRB). In one of his early acts as president, Donald Trump not only fired National Labor Relations Board General Counsel Jennifer Abruzzo but also removed NLRB member Gwynne Wilcox. Firing Wilcox upended nearly 90 years of Supreme Court caselaw and left the NLRB unable to perform its vital mission of upholding workers’ rights. So what is the NLRB, and why do workers depend on it to ensure they have a voice on the job? The NLRB is an independent federal agency tasked with safeguarding workers rights in a number of ways. - It oversees union elections – and ensures that employers abide by the law when workers seek to organize. - It also prevents and remedies unfair labor practices, again ensuring that workers are free to engage in concerted activity and access their rights under the National Labor Relations Act. The NLRB is headquartered in Washington, D.C., and has 26 different Regional Offices. - There are five seats on the Board, which are filled through presidential nomination and then Senate confirmation. - The members serve five-year terms, and the terms are staggered so that one seat is supposed to be open each year – though delays can cause vacancies to occur. The NLRB shapes labor law in several ways including by issuing decisions on cases, which sets national precedent, and by issuing rule making. - Because the president nominates members to the board, they have the ability to influence how it operates based on their priorities. - Pro-worker presidents traditionally appoint members who take the job to enforce workers rights’ seriously while pro-corporate leadership effectively limits workers’ ability to form unions and collectively bargain. - Under the previous administration, for example, the NLRB made key advances when it came to leveling the playing field for workers, such as banning the captive audience meetings employers too often used to try to thwart union elections. Currently, the board is down to just two members, which means it does not have a quorum and cannot make decisions or enforce labor laws. That means: - Workers facing unfair treatment—like illegal firings, intimidation, or bad-faith bargaining—could be left waiting months or even years for justice. - Striking and organizing workers will have fewer protections. - Employers who break the law may get away with it if cases can’t be heard. - Furthermore, this upheaval has emboldened greedy corporations looking to block workers from exercising their rights. - For example, Whole Foods (which is owned by Amazon) is arguing that they will not recognize a union formed in January because of the lack of quorum at the Board. An NLRB member can only be fired for serious misconduct—like neglecting their job or breaking the rules. No President has ever fired a Board member like this before, and there does not appear to be any valid reason to remove Wilcox. - Wilcox filed a lawsuit in response to her firing. While a DC District Court judge ruled in her favor and reinstated her, her case has gone through a number of appeals and is now headed to the Supreme Court, which recently once again removed her from her position until it can rule on the merits of the lawsuit. - Oral arguments are due to begin on May 16, which means between now and then the board is again hobbled. As more and more workers signal that they want the protections of a union contract it’s essential that we have a labor board that takes its job seriously. - This means allowing members like Wilcox to finish their terms. - And pushing our elected leaders to nominate and confirm qualified members who will take the job of protecting workers seriously. Megan Salrin is the National Coordinator for the United Steelworkers’ Rapid Response program, the union’s nonpartisan initiative for education, communication, and action on legislative and policy issues affecting USW members. Before this role, she served in USW’s Legislative and Policy Department and worked for several Members of Congress from the Midwest. Jimmy O'Donnell is a Legislative Representative for the USW, where he advocates for pro-worker policies related to labor rights, workplace health and safety, clean energy manufacturing, and workforce development. In 2022, he was unanimously elected to the position as the highest ranking African American officer in the history of America’s labor movement. The two discuss President Trump's union busting executive order from last week. It strips the fundamental right to unionize and collectively bargain from workers across the federal government at more than 30 agencies. The workers who make sure our food is safe to eat, care for our veterans, protect us from public health emergencies and much more will no longer have a voice on the job or the ability to organize with their coworkers for better conditions at work so they can efficiently provide the services the public relies upon. They begin the interview by acknowledging the accomplishments that President O'Brien and General Secretary-Treasurer Fred Zuckerman have helped their Union to achieve during their three years heading the organization. With 80,000 new members organized, great successes at the negotiating table including many of their best contracts ever like at UPS and Anheuser-Busch, an empowered rank-and-file membership that has waged over 250 strikes and led bargaining themselves against some of the world’s largest employers, the O’Brien-Zuckerman administration has charted one of the most defining and positive chapters in Teamsters history. Next, Sean shares with the audience the Union's contract campaign with their 10,000 Teamsters aviation maintenance technicians (AMTs). They're fighting for a fair contract with United, who raked in over $4 billion dollars in profits last year, but is lowballing the Teamsters at the bargaining table. At the same time, the airline wants to outsource maintenance to communist China and South America. Sean explains how United Airlines Teamsters are ensuring safety in the skies, and that Teamster members will not accept anything less than a strong new contract with the industry-leading wages and job protections they have earned. Lastly, Leslie and Sean discuss how, following a credible strike threat, more than 1,000 newly organized drivers and warehouse workers at United Natural Foods Inc. (UNFI) in Florida, Georgia, and Illinois have ratified their first Teamsters contracts. Leslie is joined by Kevin Mapp, the USW’s International Vice President of Human Affairs. Kevin coordinates bargaining in the union’s health care, containers, public sector and ship building sectors. The pair discuss the power of international solidarity in four parts. Part 1: Global Solidarity and Corporate Greed Multinational corporations operate globally, oftentimes attempting to pit workers in different countries against each other in a race to the bottom on wages and working conditions. Unionized workers, however, understand that the only answer to large-scale corporate greed is global solidarity. - The USW works with global labor federations like IndustriALL and UNI so that they can share information about operations in different countries. - The USW maintains formal strategic alliances with at least six other unions in Australia, Mexico, Germany, Brazil, and the United Kingdom. - The USW also maintains relationships with unions in a number of other countries as they work to ensure that workers have a place to succeed in the global economy. All of these relationships are premised on the simple truth that workers the world over confront many of the same challenges, and their greatest strength is solidarity. Part 2: Urgency in Liberia and Bridgestone’s Operations Nowhere has this been more urgent than in Liberia, where workers on Bridgestone’s massive rubber plantation have been struggling for decades to improve their working conditions. Japanese-owned Bridgestone is one of the world’s largest tire and rubber manufacturers. It employs more than 125,000 workers worldwide, including approximately 4,000 members of the USW. Unions in Japan, South Africa, Europe, and Brazil also represent Bridgestone workers. In Harbel, Liberia, Bridgestone operates the world’s largest contiguous rubber plantation, covering some 185 square miles. It’s owned by Bridgestone subsidiary, Firestone Liberia, and approximately 7,000 workers reside there with their families. - These workers both live and work on the plantation, buying food from the company store and sending their children to schools run by the company. - The work is difficult, slashing bush, tapping trees, draining latex into metal buckets that weigh 65 pounds each when full, and carrying them long distances to weigh stations. - This latex then goes straight into the North American supply chain, serving as the starting point for American-made tires. Part 3: Unionization and Challenges at Firestone Liberia In 1990, Terry Renninger, then president of Bridgestone’s Liberia operations, said, “The best way to think of it is as an old Southern plantation.” Indeed, in the years leading up to the formation of their union, the Firestone Agricultural Workers Union of Liberia (FAWUL), workers endured what a 2005 human rights lawsuit called “forced labor, the modern equivalent of slavery.” In 2007, workers successfully organized, and since then they’ve been making incremental progress in improving working conditions on the plantation, though serious problems remain regarding wages, health care, housing, workplace safety, and more. On top of this, in 2019, Bridgestone fired more than 2,000 workers, forcing them instead to work for contractors, doing the same work but earning significantly lower wages without benefits or other protections provided by FAWUL’s contract. According to the U.S.-based Solidarity Center: - One of the big benefits they lost was the education promised to their children, who now must walk long distances through difficult terrain to attend classes in open-air classrooms without desks or other supplies. - Workers struggle to afford protective glasses, boots, or gloves. - Living conditions are cramped, and payment for food comes out of workers’ paychecks, which can sometimes leave them with zero or negative balances on their pay slips. Part 4: Current Efforts and Hope for the Future Since then, these workers have pushed back, with the support of unions like the USW, as well as the Solidarity Center and others. - On Aug. 31, 2024, contractors voted overwhelmingly to unionize and are attempting to rejoin FAWUL. - FAWUL is currently in negotiations with Bridgestone, and one of the key issues is the fate of contractors. The USW has been proud to provide strategic and bargaining support, but the true strength comes from workers themselves who have shown they’re willing to take action. The outcome of these negotiations is still not certain, but it’s clear that workers – across the world – are strongest when they’re united. Kevin Mapp also serves as a trustee on the USW Health and Welfare Fund, is an advisory board member to the Institute for Career Development, and a member of the Board of Directors for the Michigan AFL-CIO Labor Foundation. Many of the proposals in Project 2025 are sweeping and would eliminate fundamental personal freedoms while cutting the take-home pay of millions of Americans. Leslie is joined by Maria Somma, Organizing Director for the United Steelworkers (USW). The pair explores why workers still need the PRO Act. This includes white collar workers, which Maria shares multiple examples of with the audience. Workers in the South are also eager to exercise their rights, though this is drawing backlash from anti-worker politicians in states like Georgia and Alabama. The Biden administration has done important work to correct course at the NLRB, and there are pro-worker provisions in recent investments, which are helping smooth the way for workers to have a voice on the job. This includes extensive new requirements for infrastructure projects to be “made in America” as part of the 2021 Bipartisan Infrastructure Law (BIL). Known as the Build America, Buy America Act (BABAA), this section of the law promises to stimulate American manufacturing and create jobs for American workers by ensuring that a substantial portion of BIL funding is used to purchase U.S.-made products and materials. However, workers still face an uphill battle when it comes to forming unions. The solution is to finally pass comprehensive legislation that shores up loopholes in our laws and attaches real, immediate penalties to corporations that violate workers’ rights. Leslie and Maria share the legislative solution to these issues, which is the Richard L. Trumka Protecting the Right to Organize Act (PRO Act). They detail what the law would do, which is: - Establish stronger and swifter remedies to stop employers from breaking the law - Make companies recognize contractors as part of the collective bargaining process so they can no longer continue to whittle down Union membership by subcontracting - Force an employer to reach a first contract in a timely manner with a newly organized group of workers. (No more dragging out first contracts) - Reverse so-called 'Right to Work,' regardless of state laws - Prohibit employers from forcing employees to attend anti-union meetings Recent polls show that support for unions is at a fifty-year high, and having Joe Biden, the only sitting President to walk a picket line, in office has helped workers a great deal. The administration first proposed the rule in August, after the passage of the most sweeping gun violence bill in decades, a bipartisan compromise in response to the massacre of 19 students and two teachers at a Uvalde, Texas elementary school. That law expanded the definition of those who are “engaged in the business” of selling firearms, and are required to become licensed by the ATF and therefore run background checks. The rule, which implements the change in the law, will take effect 30 days after it is published in the Federal Register. There are already roughly 80,000 federally licensed firearms dealers. Administration officials believe the new rule will impact more than 20,000 dealers who have gotten away with selling firearms without a license and performing background checks at places like gun shows and over the internet by claiming they aren’t “engaged in the business” of firearm sales. Leslie is joined by two young women, Afghan refugee Sola Mahfouz and Malaina Kapoor (Stanford ‘25), who are raising awareness about the untold story of millions of Afghan women brimming with potential and longing for freedom in their acclaimed book, “Defiant Dreams: The Journey of an Afghan Girl Who Risked Everything for Education." Sola Mahfouz was born in Kandahar, Afghanistan, in 1996, the year the Taliban took over her country for the first time. They banned television and photographs, presided over brutal public executions, and turned the clock backward on women’s rights, practically imprisoning women within their own homes and forcing them to wear all-concealing burqas. At age eleven, Sola was forced to stop attending school after a group of men threatened to throw acid in her face if she continued. After that she was confined to her home, required to cook and clean and prepare for an arranged marriage. She saw the outside world only a handful of times each year. As time passed, Sola began to understand that she was condemned to the same existence as millions of women in Afghanistan. Her future was empty. The rest of her life would be controlled entirely by men: fathers and husbands and sons who would never allow her to study, to earn money, or even to dream. Driven by this devastating realization, Sola began a years-long fight to change the trajectory of her life, deciding that education would be her way out. At age sixteen, without even the basic ability to add or subtract, she began to teach herself math and English in secret. She progressed rapidly., Within just two years she was already studying subjects such as philosophy and physics. Faced with obstacles at every turn, Sola still managed to sneak into Pakistan to take the SAT. In 2016, she escaped to the United States, where she is now a quantum-computing researcher at Tufts University. An engrossing, dramatic memoir, co-written with young Indian American human rights activist Malaina Kapour, 'Defiant Dreams' is the story of one girl, but it’s also the untold story of a generation of women brimming with potential and longing for freedom. The two discuss how workers across the economy – from automakers to health care workers – are using their collective power to ensure they have fair contracts and safe working conditions. The first step in this process is organizing, and as workers seek greater protections on the job, they’re capitalizing on this unique moment. It’s not just the hot labor market, though the recent low unemployment has certainly helped. The pandemic helped workers in a number of industries understand that they’re essential. It has also highlighted what they needed from their employers – in terms of job security, living wages, and more – as well as the power of working together to achieve these goals. Also, Joe Biden, the most pro-labor president in recent memory, has tasked his administration with helping workers to exercise their right to form unions. This unprecedented support, and whole of government approach, has helped tip the balance back toward workers, and away from greedy corporations. Workers are also experiencing a time of great potential as we look to the clean energy transition. Clean technology – like electric vehicles – require a wide variety of raw materials and other components. It’s essential that jobs from mining to manufacturing are good, community supporting jobs. That means ensuring workers can exercise their right to organize. The final step in organizing is not, as some might think, a successful vote, but a first contract. This is where corporations like Starbucks double down on their efforts to break workers’ collective will. We’ve seen this protracted bargaining at places like Kumho and OHL/Geodis, though the USW was ultimately successful in both cases. What workers need to help them successfully weather the immense challenges they face, including getting this vital first contract, is the PRO Act. The company has grown significantly and now operates three supermarket chains, and makes the majority of its revenue from the United States. · Chedraui owns three store banners in the United States with around 375 total locations. The three banners are: o Smart & Final, which is concentrated in Southern California but also has locations in Nevada and as far east as Phoenix. o El Super, which is also concentrated in Southern California and has locations in Nevada, Arizona, and as far east as New Mexico and Juarez in Texas. o Fiesta Mart, which is entirely in Texas. Most of its locations are in either Houston or the Dallas/Fort Worth area. · Teamsters Local Union 630 won two elections at Smart & Final warehouses in the Los Angeles area just this year. The two groups at the Commerce and Riverside facilities comprise around 700 total workers. After years of suffering from low wages and poor benefits, these workers decided to join the Teamsters union to improve their workplace. · Yet, on the heels of the election at the Commerce facility, Chedraui announced that it would be consolidating its distribution operations into a single facility in Rancho Cucamonga, right before the union election at the Riverside facility. An internal company announcement distributed to workers stated that when this move takes place, the workers will have to reapply for their jobs and will not be guaranteed jobs at the new facility, regardless of their experience or how long they have worked for the company. The company has not responded to workers’ inquiries regarding the status of their jobs at the new facility and what pay and benefits will be available. · Local 630 members rallied in August and September to demand fair treatment by Chedraui, with a focus on protecting American jobs and living standards, and bargaining a fair contract. · To date, the Teamsters have filed seven unfair labor practice charges against Smart & Final and Chedraui, alleging egregious violations of federal labor law, including that the planned facility relocations and termination of all employees are motivated by anti-union discrimination; that the company has interfered with workers’ right to organize by withholding a regularly scheduled cost of living adjustment and blaming it on the Union; and by holding mandatory captive audience meetings where the company CEO promised workers benefits and job security at the new facility in exchange for rejecting the Union. · The company has been engaging in bad-faith surface bargaining, likely with the intention of running out the bargaining clock and then either attempting to decertify the Teamster bargaining units or withdrawing recognition when it transfers its operations and forces employees to reapply. · This consumer leaflet action on 10/17 comes ahead of bargaining resuming on 10/18. The Teamsters are calling on consumers to demand that Chedraui respect its US workers, cease its violations of US labor law, honor its employees’ choice to become Teamsters, and bargain a fair contract. Hamas urged Gazans to ignore it. Israel's military said the order, which has raised fears of an imminent ground offensive on the densely populated enclave, was intended to minimize civilian casualties in the war against Hamas. But the United Nations said it was "impossible" and risked a humanitarian disaster. "We call on all civilians in Gaza City to move south," Israeli Defense Minister Yoav Gallant said Friday in a press conference with U.S. Defense Secretary Lloyd Austin in Tel Aviv. "We don't want to harm them. Whoever wants to save his life should go south. Hamas is camouflaging itself inside the civilian population and we are going to go in and dismantle its infrastructure," Gallant said. More than 1,530 Palestinians and 1,200 Israelis have been killed, thousands have been injured, and hundreds of thousands of others have been displaced since the latest fighting between Israel and Hamas began. Leslie is joined by the incoming President of the United Steelworkers (USW), David McCall. During this interview, they remember the late Tom Conway, former President of the USW, who sadly passed away on September 25th of this year. While the labor movement and the union both lost a great leader, thanks to Tom’s vision and hard work, both are on firm footing and primed to continue the fight for economic justice and fairness for working families. Tom’s legacy involves innovations and breakthroughs on a number of fronts: He bargained cutting-edge contracts across USW sectors. - He understood that companies needed to be successful so they could pay workers good wages and benefits, so where he could, he worked with them. - When he couldn’t, he was relentless in his work to find ways to make sure workers’ needs remained at the forefront. - This included the 2015 oil strike, which helped secure a number of important health and safety provisions for workers. - And a number of rounds of steel bargaining that helped stave off calls for concessions and ensure fair pay and high-quality benefits. But Tom understood that fighting for working families wasn’t just about pay; it was about securing the future. - Early in his time as an international leader, Tom was instrumental in developing the Institute for Career Development (ICD), a joint labor-management training program, enshrined in a number of USW collective bargaining agreements, that offers members opportunities to learn new skills. - Under his leadership union workers and activists were able to achieve a major victory with the passage of the Butch Lewis Act, which saved the pensions of more than one million workers and retirees, including more than 100,000 USW members. Tom was also committed to building a diverse movement and many of his efforts contributed to building a strong future for workers. - He spearheaded an innovative organizing initiative connecting rank-and-file members with their fellow workers to talk about joining the labor movement. This quickly paid dividends, resulting in organizing victories in the United States and Canada, including some of the union’s biggest wins in years. - These include 3,500 faculty members at the University of Pittsburgh who joined the USW, as well as baristas at Starbucks coffee shops across Canada, and 1,500 workers at Georgia’s Blue Bird Corp. bus factory. - They join others, including waste disposal workers, professional football players, museum and library workers, high-tech workers, airport workers, prison chaplains and others, who all joined the Steelworkers’ ranks as a result of Conway’s initiative. Tom also invested heavily in building out the bench, and under his leadership, the union held its first international Next Gen conference in November 2019. - Under Tom’s direction, the USW built out our Veterans of Steel committees to make sure – to the fullest extent possible – that the union was helping those in need, and making sure veterans’ voices are heard. Finally, Tom fought relentlessly for both for fair trade and job creation. - This included working with government leaders in Washington to ensure that they enforced trade laws to prevent illegally subsidized and dumped products that damage American industries and destroy good paying jobs. - He did this work in steel, rubber and tire, and many other industries. - It also meant finding creative solutions, as well as working with companies and lawmakers to create jobs. - He formed partnerships and allied groups like the Alliance for American Manufacturing. - And more recently, his was one of the loudest voices calling for infrastructure investment. Tom will be missed a great deal, but his strength as a leader, and vision for the future, have helped countless working people and will continue to help countless more moving forward. The new USW President, David McCall, has a career of fighting for fairness and justice for workers that began as a member of Local 6787 in Burns Harbor, Indiana, where he worked as a millwright at the sprawling integrated steel facility. He joined the union's staff in 1985 and served as the director of USW District 1 from 1998 until 2019. Over the course of his career, McCall successfully fought to preserve thousands of jobs in the steel industry and beyond. The two will have a broad conversation about how national security requires sound trade policy. Here are the subtopics that they'll be covering during the interview: Manufacturing in key sectors like steel and aluminum underpins national security, providing vital resources for our military and helping the nation meet its critical infrastructure needs. Section 232s have been an essential part of this since 2018. While there have been some modifications in relations to trading partners like the European Union and the United Kingdom, these measures remain an essential part in ensuring the U.S. can protect itself and rebuild its infrastructure. Facing global overcapacity, largely driven by China’s unfair trade practices, 232 relief measures worked –and are continuing to work – as intended. - In steel, they improved industry conditions, spurred investments, and directly created thousands of new jobs. - They also allowed for needed capital investments so that U.S. steelmakers can continue to produce some of the best, cleanest steel in the world. - And domestic steel is underpinning the massive infrastructure upgrades we’re making in communities across the country thanks to President Biden’s vision and leadership. This is why a recent ruling by the World Trade Organization (WTO) was not only deeply flawed, but also dangerous. A recent decision by the dispute panel of the United States-Mexico-Canada Agreement, (USMCA), raises similar concerns about overreach. - The WTO has no standing to interfere with national security, and its attempt to do so undermines the credibility of the entire organization. - Allowing China to join the WTO, more than 20 years ago, was a mistake that has allowed the Chinese Communist Party (CCP) to leverage its position and continue its predatory practices. - Overcapacity, dumping, and illegal subsidies remain urgent concerns – which the WTO again made clear it is not equipped to address. - Until we have a broader reform of our trade system, we must instead rely on the tools we have at our disposal like filing trade cases and keeping the 232 relief measures in place. The Russian invasion of Ukraine also reinforced how critical trade is to national security. - The U.S. aluminum industry was already struggling, and then last year Century Aluminum Company idled its smelter in Hawesville, Ky.. They were the last domestic producer of commercial quantities of military-grade aluminum remaining after decades of foreign competition undercut the U.S. industry. - Energy prices caused by the war are also hurting European Aluminum producers, leaving markets open to Russian exports. - Sanctions on Russian aluminum will be a critical part of keeping not only the U.S. but the whole world safe, as will bringing new smelting capacity online. As we look to the future, domestic production and sound trade policy will be essential in another aspect of our national security: meeting our energy needs. - There is tremendous potential in areas like offshore wind, and the Biden administration is working to build out our domestic industry and secure the supply chain this industry will need to be successful. - Europe has a significant lead. - And China is ramping up production. Chinese producers are currently able to produce relatively inexpensive products because they can rely on the country’s overcapacity in steel, dominance in rare earths, and control over the supply chain, setting up a “race to the bottom.” - So the U.S. needs to act quickly. The previous administration made it clear that we cannot exist in a vacuum when it comes to trade, that we need careful coordination with trusted partners. This is why it is crucial that we’re deliberate in our work in the Indo-Pacific region. - The administration’s Indo-Pacific Economic Framework contains important priorities, including strong labor and environmental standards. - However, it’s essential that the agreement adheres to worker-centered values, and that the U.S. selects only partners who are serious about realizing these goals, and intend to meet its terms. - Only then will this new chapter make our trade policy sounder – and our nation safer. Tamara provides support to the union’s more than 50,000 health care workers across the United States and Canada. Tamara got her start as a community organizer in 2006, investigating police misconduct for the City of Pittsburgh Citizen Police Review Board. In 2009, she began working with organized labor advocating for health care workers. She now proudly bargains contracts, trains activists, and organizes workers to advocate for themselves, their patients, and our communities. The two discuss how healthcare workers are taking safety into their own hands. Health care workers made incredible sacrifices to help their communities during the Covid-19 pandemic, relying on each other to protect their patients and themselves. Now, they’re using that same solidarity to make huge improvements to their jobs, their workplaces and America’s care system. Even before the pandemic, health care workers faced urgent threats to their workplace health and safety. Workplace violence has long been a problem for health care workers. In 2016 the GAO found that health care workers were at least five times more likely to experience violence on the job as workers in other industries. Now, threats against health care workers are rising. Legislation like the Workplace Violence Prevention for Healthcare and Social Service Workers Act would help provide meaningful protections, like compelling OSHA to establish an enforceable workplace violence standard. Unfortunately, it’s been twice held up in the Senate. Longstanding problems with maintaining appropriate staffing levels were also exacerbated by the pandemic and also jeopardize health care workers’ health. Nursing shortages are a real and urgent concern. But turnover in other positions like environmental services and dietary also hurts workers across the board and the care they can provide. The pandemic created additional hazards for health care workers, like a lack of adequate PPE and exposed glaring holes in the safety net, like the lack of OSHA guidance on infectious diseases. More than 3,600 health care workers died in the first year of the pandemic alone. And more than half are still reporting symptoms of burnout. This ended up putting not only health care workers at risk, but their patients and communities as well. Now, workers are taking matters into their own hands. One of the big things health care workers are doing is organizing. New research from the AFL-CIO shows that 71 percent of health care workers would join a union if they had the chance. Late last year roughly 500 Pittsburgh area health care workers voted unanimously to join the USW for a voice on the job. Unionized health care workers are also winning good contracts. Approximately 800 USW members at Oroville Hospital in Oroville, Calif., this fall ratified a contract that not only provides significant wage increases, but also establishes a labor-management safety committee that gives a real voice to the front-line workers who best know how to address the hazards they and their patients face every day. USW members at Copper Country Mental health in Houghton, Mich., just this week ratified a contract that includes hard-fought workplace violence language. Nurses at three Steward Health Care hospitals in Florida achieved protections from unsafe scheduling and the creation of an infectious disease task force in their new agreement, while workers at Kaleida Health in New York successfully fought for wages increases, a health and safety committee and the health system’s commitment to create 500 new positions to address unsafe staffing issues. All of these successes come down to building relationships and working together – another way the USW is tackling workplace health and safety concerns in the health care sector – including a pilot program aimed at worker education and empowerment. This collective action is now resulting in better patient outcomes, more inspections for workplace hazards and better access to personal protective equipment (PPE), among many other advantages, making it good not only for workers but for whole communities. She primarily works on political and legislative projects, including overseeing much of the union’s member-to-member outreach around the 2022 midterm elections. The two discuss how Democrats, despite currently having just a slim majority in both houses of Congress, have worked with President Biden to notch major achievements in favor of workers and their families. While some don’t garner as much attention in the headlines as they deserve, many of these accomplishments are truly historic. - This includes a once-in-a-generation win on infrastructure, investing $1.2 trillion in our roads, bridges, ports and more. Politicians have been saying for years that they had an infrastructure plan, but this administration and this Congress actually delivered. - In addition to transportation infrastructure, this includes $55 billion to deliver clean drinking water to millions of Americans. - And a further $65 billion to help ensure every American has access to reliable high-speed internet. - This not only will make our communities safer, it will create and sustain good, union jobs and help us maintain our economic competitiveness. - USW members up and down the supply chain are providing and will continue to provide the goods and services needed to make this infrastructure upgrade a reality. Congressional democrats were also finally able to achieve a major victory on behalf of 1.2 million workers whose retirements were in jeopardy because of troubled multi-employer pension plans. - These workers stood to lose everything as a result of a convergence of corporate greed, unfair trade, deregulation and the financial crisis. - American Rescue Plan was a significant achievement in its own right, but one of the lesser-known, but hugely important things it did was shore up multi-employer pension plans so these workers could retire in dignity. - Even though there wasn’t a single Republican who voted for this plan, years of worker-led advocacy and Democratic action mean that more than a million families’ future is more secure. Democrats also delivered another sweeping victory for ordinary Americans this summer with the Inflation Reduction Act. - Among its many provisions, it will lower prescription drug prices by allowing Medicare to negotiate for lower drug prices for seniors and instituting inflation caps for Medicare prescription drugs and improvements to prescription benefits. The law also prevents a premium spike for Affordable Care Act enrollees. - It will also build out our nation’s capacity for solar, wind and other sources of renewable energy, which will create good, domestic manufacturing jobs and help break our dangerous dependence on foreign producers to meet our needs. - At the same time, providing incentives for a wide variety of technologies like carbon capture, direct air capture, and nuclear power will help ensure that our steel and other critical industries remain among the cleanest in the world. Not all of the work has been legislative. - Instituting a new pro-worker direction at the National Labor Relations Board means that workers have real advocates in an agency that is supposed to be protecting their rights. One of Biden’s first actions was to remove pro-corporate, anti-worker Peter Robb as NLRB general counsel. The Senate also confirmed two more board members that Biden nominated who are re-balancing the way the board works toward workers’ rights. - Just as importantly, Biden nominated a union member to run the Department of Labor and put workers and their advocates in key positions overseeing safety. - Biden issued executive orders in support of American manufacturing, including establishing the new Made in America office to review any request to bypass the rules and maximize domestically-manufactured components for federal projects. - And a new inter-agency task force on worker organizing and empowerment is harnessing the power of all government agencies to advance workers’ rights. In order to keep up this momentum, working people will need to vote in the midterm elections. Republicans made it clear that they stand against many pro-worker initiatives and intend to tip the balance back to pro-corporate interests if elected. Leslie is joined by Leeann Foster, International Vice President of the United Steelworkers (USW), North America’s largest industrial union. They’re 1.2 million members and retirees strong in the United States, Canada and the Caribbean. They proudly represent men and women who work in nearly every industry there is. The two will discuss the USW's holistic approach to workplace health and safety. This includes their work identifying common trends in fatalities and life altering injuries, as well as laying out a sector specific plan for education and effective hazard identification, controls and communication. The USW's work has been similarly successful in making manufacturing processes safer and helping workers avoid exposure to extreme heat or toxic substances like silica and beryllium. The USW has also been making important strides on other fronts when it comes to health and safety. One important way is through helping workers who are facing the threat of intimate partner violence. Domestic violence increased significantly during the pandemic. The American Journal of Emergency Medicine said that domestic violence cases increased by 25 to 33 percent globally. The National Commission on COVID-19 and criminal justice shows an increase in the U.S. by a little over 8 percent, following the imposition of lockdown orders during 2020. The Centers for Disease Control and Prevention has estimated that about 20 percent of women and 14 percent of men across the United States have experienced “severe physical violence.” Workers experiencing domestic violence often need time to focus on getting safe and the security of knowing that they can return to work when they’ve been able to do so. That’s why the USW is now negotiating domestic violence protections and resources into their contracts across the union. This includes two recent contracts with major employers in the paper sector: Domtar and Packaging Corp. of America, covering over 29 mills and 44 box plants and thousands of workers. Union-negotiated domestic violence leave helps provide time off for court appearances, relocation, counseling and more without eating up vacation or sick days. Workers also won’t need a doctor for an excuse – counselors, domestic shelter employees and spiritual leaders can also speak to what is happening with the employee. In some cases, workers can also request changes to working hours, transfer to alternate worksites or vacation pay advances. They can also ask for help in safety planning, like identifying hiding places or an escape route. Other sectors are also negotiating this important language. The USW has been having success with this issue in both the United States and Canada, not just because it’s the right thing to do, but also because it is a true workplace health and safety issue. The Department of Labor estimated that domestic violence victims lose nearly 8 million days of paid work per year. It can also affect the health and safety of other workers if abuses show up in the workplace. Some USW members even receive training in how to help advocate for their peers, help connect them with community resources, and intervene with management when needed. Because the union believes that gender equality and the right to a safe workplace go hand in hand, the USW is also advocating for other holistic health and safety protections. These include: - PPE that fits all body shapes - Resources to combat sexual and other harassment - Comprehensive bathroom, showers and change-room policies - Pregnancy issues including new motherhood issues and breastfeeding - Opportunities to address stress,mental health and work-life balance Not everyone experiences work or their work environment the same way, but the USW believes that all are entitled to health and safety on the job. Leeann Foster has served the union for more than 25 years, working to negotiate strong contracts, advocate for sound trade policies, facilitate educational opportunities and fight for safer workplaces. She oversees more than 550 locals and more than 30 bargaining councils in the USW’s paper sector. Leslie is first joined by Vincent Perrone, Teamsters International Trustee and a member of the Teamsters National Negotiating Committee for the UPS contract. He's also the President of Teamsters' Local 804 in New York. The two discuss the historic new UPS contract won by the Teamsters. Highlights of the tentative 2023-2028 UPS Teamsters National Master Agreement include: - Historic wage increases. Existing full- and part-time UPS Teamsters will get $2.75 more per hour in 2023. Over the length of the contract, wage increases will total $7.50 per hour. - Existing part-timers will be raised up to no less than $21 dollars per hour immediately, and part-time seniority workers earning more under a market rate adjustment would still receive all new general wage increases. - General wage increases for part-time workers will be double the amount obtained in the previous UPS Teamsters contract — and existing part-time workers will receive a 48 percent average total wage increase over the next five years. - Wage increases for full-timers will keep UPS Teamsters the highest paid delivery drivers in the nation, improving their average top rate to $49 per hour. - Current UPS Teamsters working part-time would receive longevity wage increases of up to $1.50 per hour on top of new hourly raises, compounding their earnings. - New part-time hires at UPS would start at $21 per hour and advance to $23 per hour. - All UPS Teamster drivers classified as 22.4s would be reclassified immediately to Regular Package Car Drivers and placed into seniority, ending the unfair two-tier wage system at UPS. - Safety and health protections, including vehicle air conditioning and cargo ventilation. UPS will equip in-cab A/C in all larger delivery vehicles, sprinter vans, and package cars purchased after Jan. 1, 2024. All cars get two fans and air induction vents in the cargo compartments. - All UPS Teamsters would receive Martin Luther King Day as a full holiday for the first time. - No more forced overtime on Teamster drivers’ days off. Drivers would keep one of two workweek schedules and could not be forced into overtime on scheduled off-days. - UPS Teamster part-timers will have priority to perform all seasonal support work using their own vehicles with a locked-in eight-hour guarantee. For the first time, seasonal work will be contained to five weeks only from November-December. - The creation of 7,500 new full-time Teamster jobs at UPS and the fulfillment of 22,500 open positions, establishing more opportunities through the life of the agreement for part-timers to transition to full-time work. - More than 60 total changes and improvements to the National Master Agreement — more than any other time in Teamsters history — and zero concessions from the rank-and-file. Leslie is then joined second by Greg Unterseher, Manager of Pilot Representation for the Teamsters Airline Division. They detail the Teamsters lawsuit against Cape Air and Republic Airways for unlawfully requiring pilots to sign employment contracts with non-compete clauses that impose penalties ranging from $100,000 to $250,000. The lawsuit asserts the employment contracts are an attempt by the airlines to change pilots’ working conditions unilaterally, in violation of federal labor law under the Railway Labor Act. Leslie is joined by Steve Sallman, Director of the United Steelworkers Health, Safety and Environment Department, where he's worked for over 19 years. The two discuss the urgent and timely topic of protecting workers from deadly heat. As the planet gets hotter, and wide swaths of the United States are seeing record temperatures, heat is becoming an ever more urgent workplace health and safety issue – in both in-door and out-door occupations. It’s no surprise that unions work to provide solutions. The USW works to negotiate common sense solutions into their contracts like rest breaks, ample supplies of water, electrolytes, and proper ventilation. UPS drivers made this a centerpiece of their recent contract negotiations too, signaling that this was so significant that they were willing to strike as necessary. They ultimately got what they needed, including fans and air conditioning in their trucks. However, all workers need protections, starting with a national standard on heat exposure like workers have for other hazards like falls and asbestos exposure. Without proper controls and protections, working in the heat can cause illness and even death. According to the BLS, there have been 436 work related deaths caused by heat exposure since 2011, and an average of 2,700 cases per year of heat-related illness. The real number could be much higher, given that many workers who are exposed to extreme heat are undocumented and reluctant to come forward. Even when it’s not immediately obvious, heat is harming a worker’s body, which can cause them to suffer long-term consequences, like renal damage. The Biden administration is taking this threat seriously, enabling workers to make some headway. Just last month, President Biden ordered the DOL to issue the first ever hazard alert for heat. In the same announcement, the department also announced that OSHA would intensify enforcement of existing safety provisions when it comes to heat. Biden also announced funding to improve weather forecasting, as well as additional money for clean drinking water in Western states impacted by drought. A handful of states – California, Colorado, Washington, Oregon and Minnesota – also issued their own heat exposure standards. Only Minnesota and Oregon have protections for indoor workers as well. But corporations and the Republicans who serve them are unfortunately pushing back hard, lobbying against protections and, in some cases, even overturning them. Business groups in Oregon are suing the state over heat related workplace protections. Even worse, Republicans in Texas earlier this summer even took the extreme step of passing a law that eliminates local ordinances requiring water breaks for construction workers. After Austin in 2010, and Dallas in 2015, required water breaks, reported heat illness numbers in Texas dropped from 770 to 170. Now workers are bracing for what comes next. This isn’t just a matter of lost productivity, though heat can impact that as well. It’s truly life and death. In June, a postal worker in Texas collapsed and died in triple digit heat. This summer, a Houston-area construction worker also collapsed and died of hyperthermia. Countless more will soon be at risk once the new Texas law goes into effect. The USW continues to fight for workers, as demonstrated by the union’s comments to OSHA in the federal register. Until then, the USW continues to push for an OSHA standard and works to protect workers through their contracts and other health and safety work. For roughly 15 years, Mr. Paul and AAM have worked to make American manufacturing a top-of-mind issue for voters and our national leaders through effective advocacy, innovative research, and a savvy public relations strategy. Leslie and Scott discuss the Department of Commerce's investigation into whether Chinese manufacturers are re-routing solar panels through four Asian countries in an attempt to avoid U.S. tariffs. Here is more background on the subject from Scott's colleagues at AAM, Elizabeth Brotherton-Bunch and Matthew McMullan: The investigation came about after California solar panel maker Auxin Solar filed a petition with the Commerce Department asking for the investigation, arguing imports from Malaysia, Vietnam, Cambodia, and Thailand were actually made in China. Auxin also had support from Members of Congress on both sides of the aisle and in the Senate and House, with Ohio Sens. Rob Portman (R) and Sherrod Brown (D) writing to Commerce Secretary Gina Raimondo: “As we understand it, these operations use raw materials, labor, capital investment, and research and development from China. Moving to a third country to assemble a product with inputs from the country subject to the original AD/CVD order is textbook circumvention. (AD/CVD stands for Antidumping and countervailing duties, which are intended to offset the value of dumping and/or subsidization, thereby leveling the playing field for domestic industries injured by such unfairly traded imports). As you know, if legitimate circumvention allegations go unaddressed, entire domestic industries and thousands of American manufacturing jobs are at risk.” It all seemed pretty straightforward; Commerce would investigate the claims and issue a decision. If you follow this blog, you know that these sorts of trade cases happen all the time. But ever since Commerce moved forward with the probe, solar importers have done a full court press to convince everyone that the investigation would spell doom for the industry. There have been many, many many stories in recent weeks arguing that the solar industry is now “frozen” because of the investigation and that it will hinder the Biden administration’s climate goals. They’ve also argued that shipments have already slowed because of the investigation. It all strikes us as somewhat odd, given that no decision has been made (and thus no new tariffs have been issued). What do these folks have to fear? That’s the argument that Auxin CEO Mamun Rashid made in a recent interview with E&E News. “If there’s been no cheating going on, there’s absolutely nothing to worry about,” he said. “If I’m a manufacturer overseas, or I’m an importer, and I know I wasn’t participating in any kind of circumvention, I wasn’t cheating, I don’t have anything to worry about. I don’t understand why the concern is there.” Rashid also rejected the argument that tariffs, if they are eventually placed on these products, will harm the industry and limit progress on reducing climate emissions. He said: “I can only speak to my experience. In the last 14 years, we have seen tariffs being instituted and we’ve seen the predictions that were made on what would happen if the tariffs were put in place. And it has never materialized. Deployments have continued to grow double digits and outperform predictions, even prior to tariffs being imposed, and pricing has continued to fall. I have no reason to believe it’ll be any different this time.” So why is SEIA mounting such an aggressive campaign against this investigation? Well, solar is an obviously important source of green energy and therefore plays a huge role in our national climate goals, but it’s also an industry, and a business. And as a trade association representing lots of importers it’s performing its primary function: Protecting their profits. It could also be because some of its member companies are the same ones that were originally targeted by the tariffs that these imports are accused circumventing, as the Prospect points out, and that some indeed source from suppliers that use slave labor in China’s Xinjiang province — where the government has forced an estimated 1 million Uyghur and other typically Muslim ethnic groups into detention camps, according to researchers and news organizations. And this big push could also be because it could be gearing up to take a run at overturning a ban on imports made by that labor that’s set to take effect in about six weeks. WEBSITEs: 1. The United States used to be on the cutting edge of manufacturing innovation, but declining investment and decades of bad trade deals left the country at a competitive disadvantage, resulting in: - Plummeting numbers of good, manufacturing jobs. (The BLS calculates that manufacturing employment fell from 19.6 million in 1979 to 12.8 million in 2019 – down 35 percent) - Fractured communities. This has particularly hurt Black, Brown and other workers of color. - And increasing reliance on foreign nations for critical goods. It’s long been clear that we need comprehensive legislation to better compete with China and other nations, regrow our critical supply chains and invest in manufacturing now and into the future. There are currently two bills – one in the House and one in the Senate – that are aimed at helping the United States stay competitive against China and protect workers against greedy multi-national corporations who seek out low wage and illegal subsidies in foreign countries. - The Senate bill is the United States Innovation and Competition Act (USICA). - The House bill is America COMPETES Act (COMPETES). The bills will soon go to conference so Congress can reconcile the differences between the two versions. During the first half of the show, Leslie is joined by Peter Vargas, a 30-year insurance sales agent with AAA in Northern California. They discuss how In June, about 460 AAA insurance sales agents in Northern California organized with Teamsters Local 665 in San Francisco – a unique group of licensed 'white-collar’ workers to have formed a union. They’ve been in contract negotiations since August and the company is stalling, failing to seriously bargain, and making changes to the status quo which is not allowed during the bargaining period. The company has rejected nearly every union proposal, has failed to consider the workers’ positions, and has failed to make any counter offers. Rather than get serious about negotiating, the company has actually proposed a rule that would, in effect, allow the company to terminate any employee who curses in front of a “member.” “Member” refers to a current or former member of any AAA club or any current, former or potential customer --- so basically anyone. There's also a punishment for being 1-minute late. The company has also imposed a two-tier compensation scale that guarantees that newly hired employees will never have the same opportunities as more tenured employees. Calls from customers for sales agents are getting routed out to lower paid workers. Managers have control over which sales agents can receive calls at their desk and can shut the line down – and these calls are the agents’ livelihoods. The local union has filed seven unfair labor practice charges against the company. AAA has refused to bargain over ‘just cause’ and fair compensation. The list goes on. The sales agents are motivated commission-earning workers who’ve built up this business and are determined to get a contract and to be treated fairly and with respect. During the second half of the show, Leslie is joined by Andre Solelyn, a Terminal Operator at United Metro Energy and Teamsters Strike Captain. The two discuss how essential workers at the United Metro Energy oil terminal in Brooklyn, such as Andre, have been on strike since April 19, 2021. The workers provided gasoline, diesel, and heating oil to New York throughout the pandemic, while the company’s billionaire owner, John Catsimatidis, paid them wages as much as 50% lower than at other city oil companies. The company has sent letters to eight workers over the course of the strike telling them that they have been “permanently replaced.” The firings have illegally targeted union activists. The National Labor Relations Board is currently investigating charges related to the firings. UMEC terminal workers, fleet mechanics, and service technicians voted to join Teamsters Local 553 in February 2019, but Catsimatidis dragged out negotiations for a first contract for two years, precipitating the strike. While other unionized fuel terminals in New York City pay good wages and provide quality benefits, UMEC has for years undercut those wages and only offered an expensive health plan that is not accepted by many doctors. In November, the New York City Comptroller opened an investigation into complaints that United Metro Energy has not paid workers the prevailing wage when delivering heating oil to City buildings. The oil terminal distributes heating oil to New York City schools and hospitals, as well as fuel to area gas stations. Teamsters Joint Council 16 and its 27 affiliated local unions represent 120,000 workers in the Greater New York area and Puerto Rico.
