As the trial trundles on, it's becoming harder and harder to understand the sequence of events, especially when the evidence in court is not heard in any particular order - and certainly not in the order things actually happened. Mr Y's decision not to say anything prior to coming to court means he can throw curveballs whenever he wants. The judge could tell the jury to make an adverse inference about anything he says in the witness box but didn't tell to police when interviewed - but she doesn't. The jury will have to work it out for themselves. But will they?
