Employment Tribunal claims remain at an extremely high level. The statutory disciplinary procedure has been abolished. In its place the ACAS Code of Practise on Discipline and Grievance has been updated and increased in importance. Employment tribunals apply strict guidelines where employers dismiss for poor conduct for performance or capability; failure to follow procedures can lead to a finding of unfair dismissal and up to a 25% rise in compensation, if the ACAS code is not followed.
