Topic of the Week (9/15/23):
We're back! Today is the Captain's Log edition - let's catch up on all that happened over the summer! Lots to talk about!
The Maritime Professorᵀᴹ presents By Land and By Sea - an attorney breaking down the week in supply chain
with Lauren Beagen (Founder of The Maritime Professorᵀᴹ and Squall Strategies)
Let's dive in...
But first, our TOP THREE STORIES OF THE WEEK!
1- We're still on Federal Maritime Commission rulemaking watch - we're still waiting on the detention and demurrage billing/invoicing requirements final rule and any text to be released from the unfair or unjustly discriminatory methods definitions rule. The Supplemental Notice of Proposed Rulemaking on the Unreasonable Refusal to Deal or Negotiate w/r/t Vessel Space Accommodations received 25 comments over the summer, have a look: https://www.regulations.gov/document/FMC-2023-0010-0032
2 - The FMC will hold their next Commission Meeting on September 21 at 1pm.

3 - FMC Commissioner Rebecca Dye is convening her Supply Chain Innovation Teams to address: empty container return, early return date, and container pickup (notice of container availability).

4 - FMC Commissioner Carl Bentzel released an RFI (request for information) for comments and responses to his Maritime Transportation Data Initiative (MTDI) Recommendations and Views Report. Comments due by Oct 16, 2023.
https://www.regulations.gov/document/FMC-2023-0016-0001
5 - Revisited article from May 2023 in JOC.com re: FMC statutory authority over through bills of lading and rail storage charges:
https://www.joc.com/article/us-shipping-interests-want-fmc-regulate-rail-storage-fees_20230503.html
6 - Greg Miller appropriately breaks down the need (or non-need) for alarm in his FreightWaves article "Shipping 'traffic jam' at Panama Canal: why it's not a crisis (yet)" (Aug 23, 2023)
