Janice Green, Esq. a family law attorney author, and Professor with a career spanning more than 44 years, discusses the unique challenges of getting divorced after 50.

I bring you this guest because I am getting more and more calls about the big D and whether the spouse who is calling me can afford to and qualify to keep the house.

It reminds me a lot of during and after the 9/11 Tragedy, people faced a world that was changing (we thought was ending for about 2 weeks) and made life changes like moves and divorces, and marriages.

Of course, one of the first things that come to mind: Can I keep the family home? But there are so many more issues that are the same or even more important.

Will I still get his/her spousal social security

Will I get part of the pension he/she gets

Will I get spousal support? What if he/she quits the job and doesn't have the income to pay me?

How much cash will I get and is it enough?

Will I have the same health insurance?

What if he/she remarries, do I still get their pension/social security or out in the cold?

I bought that, shouldn't I get to keep it?

What is community property and what is mine?

Do we even need a lawyer, he/she says we don't?

...and Yes, how can I pay them out of the house and keep the house?

The big difference is that after the age of 50 you have more assets and are not able to recover as fast from the loss of assets or income as when you were young.
